Bustinza´s background and Key Experiences

With more than 18 years of professional expertise in the Peruvian mining industry, I have a diverse professional journey that has substantially shaped my skills and perspectives. I began my professional background in the mining industry as legal counsel in well-known mining companies, where I developed foundational skills in negotiations with local communities, communications skills, corporate and environmental law, legal advice to other internal areas, regulatory compliance and dispute resolution matters among others.

After that, I moved into the position of Head of Legal, where I had the opportunity to advocate for the company’s interests while also addressing community concerns and promoting responsible mining practices. This role was pivotal as it allowed me to, I led a comprehensive risk assessment process that identified key compliance risks associated with our mining operations, which directly aligns with the requirements of my current position at Compañia de Minas Buenaventura (NYSE: BVN). Most recently, I worked as Head of Compliance, where I was the development and implementation of a comprehensive corporate compliance policy tailored to the mining sector. This policy is a milestone in the industry due to included policies and procedures that addressed regulatory requirements, risk management, ESG and ethical standards, but also builds stakeholder trust, enhances operational efficiency, fosters a culture of compliance, and provides a competitive edge in the industry.

Consequently, these experiences have played a significant role in my current position and assist my team in achieving our goals.

Challenges of Integrating Technology into Compliance Programs across Latin America

The incorporation and integration of technology in the Compliance Programs has been progressive, perhaps slower than expected. There are various challenges that can be emphasized. Firstly, LATAM countries have a different level of technological maturity along with variety compliance regulatory framework. One of major hurdle is the lack of uniformity in compliance regulations across LATAM region, which may cause misunderstandings and discrepancies in the execution of technology initiatives. Moreover, adopt new technological solutions during the carry out of Compliance Programs and the consequent resistance to change from employees is a common barrier, even in the mining industry.

  ​Focusing on compliance and security during technology integration allows organizations to build a strong framework for their Compliance Programs, ensuring they meet regulatory requirements while also enhancing overall operational efficiency.

To address these challenges, it is crucial for compliance teams to implement an effectively communication strategy in its organizations by demonstrating the real benefits of technology in compliance processes. Bear in mind that technology solutions should be tailored to each need organization and the specific regulatory requirements of each country.

Implementing Strategies to Foster Innovation in the Compliance Teams

Currently is imperative to foster technological innovation and solutions within compliance teams. The process automation can be helpful for risk management to prevent, mitigate and control the risks such as the cyber-attacks or data protection, investing in advanced cybersecurity, robust data security and privacy measures can contribute to the security of sensitive data.

Another strategy will be creating an environment where compliance team members feel comfortable sharing their point of views and insights, which encouraging innovative solutions to compliance challenges. For instance, the synergy of compliance teams with IT is essential to develop a user-friendly compliance tracking tool such as a due diligence platform. This tech-tool not only simplified reporting procedures but improved transparency, enabling faster detection of compliance gaps and facilitating more proactive risk management.

Focusing on compliance and security during technology integration allows organizations to build a strong framework for their Compliance Programs, ensuring they meet regulatory requirements while also enhancing overall operational efficiency.

Leveraging Technological Advancements to Improve Compliance Programs

The latest technological advancements have had an impact in the compliance programs. As illustrated, technologies facilitate real-time communication with all levels of the organization as well as allow a consolidated record of communications and documents.

There are technologies tools based on Blockchain that offers to compliance teams’ transparency and traceability in operations or transactions. Likewise, incorporating data analytics and [the popular] artificial intelligence to compliance processes will assist identification of potential risks more effectively. Therefore, automated monitoring systems can minimize the workload on routine or low value-added tasks.

A Culture of Innovation and Collaboration

In the dynamic world of technological and innovation advancement, compliance teams require environments where all members feel empowered to generate creative solutions and share their ideas, perspectives, goals and contributions as well as being permanently trained in aspects related to technological advances and improve the effectiveness of compliance programs. For instance, brainstorming meetings or regular workshops.

Another key aspect is for compliance members to encourage an “experimental mindset”, seeing failures as valuable learning experiences rather than obstacles, which further strengthen this culture. Teamwork with different areas not only improves the ability to solve problems but also promotes a sense of the compliance culture in the organization and consequently, allowed to share the responsibility for results throughout the organization.

Advice to Aspiring Leaders and Passionate Innovators in the Mining Industry

Permanently, the mining industry faces compliance challenges on different line fronts. Under this challenging scenario, my suggestion for aspiring leaders and innovators who want to leverage technology to tackle compliance obstacles is to stay informed and trained regarding the regulatory frameworks and the latest technological advancements, both are crucial for developing effective solutions in the organizations that not only meet compliance standards but improve operational efficiency.

Moreover, familiarize yourself with emerging technologies such as artificial intelligence, data analytics and blockchain, as these tools can significantly enhance compliance culture and processes in the organizations.

Certainly, compliance officers, aspiring leaders and innovators should continue facing the challenges but if they deeply internalize the importance of technology and innovation in tackling compliance challenges, it will not only lower expenses but also enhance the efficiency of compliance programs.

Furthermore, encouraging a culture of continuous improvement within compliance teams, where experimentation and learning from mistakes are valued, will not only promote innovation but also empower the teams to create inventive solutions to compliance challenges, ultimately contributing to a more sustainable and responsible mining industry.
